Terms and Conditions

§1 Scope (1) These General Terms and Conditions are part of all business relationships between the company MORBID CLASSICS (sub-label of the company Morbid Generation Records), Kastanienalle 8, 23970 Wismar, Germany, hereinafter simply referred to as MORBID CLASSICS, and its customers. (2) Our general terms and conditions apply exclusively. Any customer conditions that conflict with or deviate from our terms and conditions will not be recognized unless MORBID CLASSICS has expressly agreed to these in writing in individual cases.

§2 Conclusion of the contract (1) The sale of goods only takes place in normal household quantities. The display of the MORBID CLASSICS range on computers accessible via the Internet does not constitute an offer.
(2) By sending his order to MORBID CLASSICS, the customer is making an offer. The customer receives a confirmation of receipt of the order by email. MORBID CLASSICS will inform the customer separately about possible errors in the information about the product range on the website and make them a corresponding counteroffer.
(3) The contract with MORBID CLASSICS is concluded when MORBID CLASSICS accepts this offer. Acceptance is subject to the availability of the ordered goods or services. If MORBID CLASSICS is unable to accept the customer's offer, the customer will be informed of this in electronic form.
(4) The contract is only concluded with persons with full legal capacity. If someone is not fully legally competent, written permission must be sent to us by email or to our home address MORBID CLASSICS, Kastanienallee 8, 23970 Wismar, Germany, from the legal guardian. If the transaction is not objected to by the legal guardians within 14 days of delivery, we assume tacit consent.
§3 Delivery (1) MORBID CLASSICS will immediately deliver the ordered goods to the address specified by the customer in the order. MORBID CLASSICS is entitled to make partial deliveries.
(2) Delivery takes place at the shipping costs stated in each individual case. All risks and dangers of shipping are transferred to the customer as soon as the goods are handed over by MORBID CLASSICS to the appointed logistics partner.
(3) Information about the expected delivery period is non-binding if MORBID CLASSICS has not given the customer a binding promise in writing in individual cases.

§4 Retention of title Delivered goods remain the property of MORBID CLASSICS until all claims against the customer have been settled in full.

§5 Due date and payment (1) MORBID CLASSICS only accepts the payment methods shown to the customer during the ordering process.
(2) The purchase price is due upon conclusion of the contract.
(3) MORBID CLASSICS does not need to take back goods that have been used, i.e. worn more often than just for checking and trying on, or goods that have been damaged by the customer. The full purchase price as well as all additional costs incurred, such as re-sending the goods complained about by the customer, must be reimbursed by the customer.
(4) §5 (3) also applies if the manufacturer's labels have been removed or the manufacturer's original packaging has not been returned.

§6 Revocation (1) The customer is entitled to revoke his declaration of intent to conclude the contract within 14 days of receipt of the goods by sending the goods back to MORBID CLASSICS. To meet the deadline, it is sufficient to send the goods on time. The customer bears the burden of proof for the dispatch and receipt of the goods to be returned.
(2) Manufacturer labels, additional packaging material (brochures, instructions, etc.), original manufacturer packaging, etc. must be returned.
(3) The consumer bears the costs of returning goods unless the goods or services delivered do not correspond to those ordered.
(4) In the event of revocation, MORBID CLASSICS will pay back any purchase price that has already been paid to the customer.
(5) Cash on delivery: The company MORBID CLASSICS reserves the right to charge an expense allowance of 10 euros for refusing to accept cash on delivery and non-collection when notified by the post office.

§7 Data protection (1) In accordance with §33 BDSG, MORBID CLASSICS points out that personal data is processed and stored electronically for billing purposes as part of the execution of the contract.
(2) Use of personal data: MORBID CLASSICS uses your data exclusively to be able to fulfill the contract concluded with you.
(3) Passing on information: MORBID CLASSICS does not pass on personal data to third parties.

§8 Liability (1) For damages due to the lack of properties that MORBID CLASSICS has guaranteed, as well as for damages caused by intent or gross negligence of its legal representatives and/or its senior employees
